Former FBI Director James Comey surrendered to authorities in Virginia on Wednesday to face charges of threatening the life of US President Donald Trump through a social media post. The indictment alleges Comey acted 'knowingly and willfully' to threaten the president and transmitted threats across state lines.
In May 2025, Comey posted a photo on Instagram of seashells arranged to form the numbers 86 and 47. Trump claimed this was a coded threat. According to the Merriam-Webster dictionary, '86' is slang for 'to throw out' or 'to get rid of,' while Trump is the 47th president.
Comey's attorney, Patrick Fitzgerald, called the case a 'vindictive prosecution,' arguing it was brought to punish Comey for exercising his legal rights. At the hearing in Alexandria, Comey did not speak or enter a plea and was released without conditions.
Former senior Justice Department official John Keller said the number '86' is ambiguous and does not necessarily imply violence, noting that Comey's open posting on a public platform suggests no intent to convey a threat.
The charges come as the Trump administration intensifies criminal prosecutions against perceived political enemies. Last year, Trump publicly called for charges against Comey in a social media post.
