As Uzbekistan's renovation program continues to reshape urban landscapes, many property owners facing expropriation are asking what compensation they can expect. One of the most common questions is whether an owner has the right to demand real estate in another country.
According to the law, such a demand does not fall under the compensation mechanisms provided for renovation. Typically, the owner is offered equivalent housing within Uzbekistan, monetary compensation, or another option stipulated by the specific project's terms and legislation.
The core principle remains the protection of the owner's right to fair compensation for the value of their property. The compensation must correspond to the market value of the expropriated housing.
If the owner chooses a cash payment, they independently decide how to use the funds. Subsequently, they are entitled to purchase property both in Uzbekistan and abroad – but this is a personal decision of the owner, not part of the renovation project's obligations.
In other words, after receiving compensation, a person can choose any way to use the funds, but the renovation organizer is not obliged to select housing abroad or handle its purchase.
This is because buying real estate in another country requires resolving additional issues: compliance with foreign legislation, paperwork, registration of property rights, tax obligations, and currency procedures. Such actions go beyond the authority of renovation project organizers.
Thus, a demand to provide an apartment or house outside Uzbekistan is not among the legally stipulated compensation options. At the same time, the owner has the right to full and fair compensation for their property.
To avoid disputes, it is recommended to pre-agree in writing all terms of compensation – whether a new apartment, cash payment, or another option.
