The Russian State Duma has adopted a law significantly tightening regulations for labor migrants and their families. Under the new legislation, if a migrant's patent or work permit is revoked or not extended, the foreigner must leave Russia within 15 days. This requirement also applies to minor children, including adopted and foster children.
The law introduces a mandatory income requirement: migrants must earn no less than the regional subsistence minimum, adjusted for a coefficient, for themselves and each family member. If income falls below this threshold, the labor contract is considered terminated, the period of stay is shortened, and the patent is not issued or renewed.
A new income monitoring mechanism is established: tax authorities will provide the Ministry of Internal Affairs with data on migrants' incomes for three, six, nine, and twelve months. The Social Fund will supply information on their employment. The Ministry gains the right to verify the presence and level of income, as well as the payment of fixed advance personal income tax payments.
If a temporarily or permanently residing foreigner's income falls below the subsistence minimum within a year from the date of issuance of a temporary residence permit or residence permit, these documents are annulled. Exceptions include full-time students, pensioners, disabled persons, and minors. If a migrant loses a job but finds a new one within three months and meets the income requirements, the permit is not revoked.
Most provisions come into force on January 1, 2027. From March 1, 2027, the income requirement and stay reduction mechanism take effect. Rules on data exchange between state bodies come into force 90 days after the law's official publication.
